Employment


In the Employment Tribunal he has particular experience of complex, high-value claims involving race, sex, part-time workers and fixed-term employees, as well as all the classes of unfair dismissal such as public interest disclosure and TUPE.


Caspar has also litigated some of the first multi-day cases involving the more recently demarcated areas of discrimination such as age and sexual orientation obtaining six figure settlements for his clients.


Caspar has a particular expertise in litigating Disability Discrimination Cases (especially mental impairment) as a result his grounding in personal injury.


Like many specialists in the field he has been involved in the large number of collective equal pay cases that are making their way through the Tribunal.


He acts for employers ranging from large multinational City Institutions to Charities, highly remunerated employees (particularly from the City and or the professional service sectors) and for employees collectively through their Unions.


Caspar also litigates in the High Court where his practice ranges from wrongful dismissal, through pension (especially public sector pensions) and restrictive covenants / confidential information (particularly injunctive relief) to judicial review of collective employment matters.


Caspar regularly practices in the employment field of Sports law and has worked for Chelsea, Spurs and Newcastle in cases involving team and employee moves, discrimination and contract claims by players and or managers. Further Caspar has acted for individuals surrounding termination of their old contracts and the terms of their new contracts such as Gus Poyet.

 

Regulation


Caspar is an experienced regulatory lawyer. He has managed a broad range of cases from simple misconduct (such as a male psychologist charging his female patients for sex) to complex matters involving detailed expert evidence arising out of inappropriate psychological risk assessments to Parole Boards as to whether violent and or sexually dangerous men should be released.


Caspar defends professionals charged by their regulatory bodies that now come under the aegis of the Health Professionals Council. His work includes challenging the compliance of regulatory organisations, on behalf of his clients, with the Human Rights Act and either appeals to the High Court or where appropriate, Judicial review.


Caspar also prosecutes and defends in statutory disciplinary hearings such as those regulating the emergency services. As a result of his broad experience in employment law he is also able to carry out independent investigations by employees concerned at a breach of professional standards with or without expert assessors in the particular discipline.

 

Personal Injury


Caspar has a special interest in injuries arising from work such as psychiatric claims or other occupational diseases particularly, asbestos. His experience as a personal injury practitioner informs his expertise in employment law and he is particularly suited to advise and act in cases where a claimant may have a choice of remedies in either the statutory tribunals or the Common Law courts and where important strategic decisions need to be made.

Memberships & Appointments


Caspar is on the Executive Committee of the Industrial Law Society, a member of the Employment Law Bar Association and the Employment Lawyers Association. He was a Member of the working party that devised the Code of Guidance for Experts under the Civil Procedure Rules.

Caspar is a member of the ELAAS Scheme at the Employment Appeal Tribunal and undertakes work for the Bar Pro Bono Unit.

Publications


Caspar Glyn drafted the Personal Injury Particulars of Claim that appear in Bullen & Leake and contributed to the Employment section. He wrote the personal injury specialist section of Sweet & Maxwell's "Fast Track Practice" and was invited by the Personal Injury Bar Association to contribute a specialist section to the Personal Injury Handbook.
