Malvicini v Ealing Primary Care Trust
Some claimants who suffer minor physical injuries go on to develop seriously disabling somatic symptom disorders, such as Conversion Disorder.
Such claims are often met with the allegation that the claimant is malingering, or so vulnerable to psychological illness that severe disability would soon have followed anyway.
Dan Lawson represented Mrs Malvini in this recent High Court case where both lines of attack were successfully met, the judge discounting the claim by just 10% for underlying vulnerability.
