Cloisters wins ‘Barristers’ Chambers of the Year’ and ‘Case of the Year’ at Eclipse Proclaim Personal Injury Awards 2015

Cloisters is delighted to announce that it has won two awards at the Eclipse Proclaim Personal Injury Awards 2015:  ‘Barristers’ Chambers of the Year’ and ‘Case of the Year’.

The case in question, JXMX (A Child) v Dartford and Gravesham NHS Trust [2013] EWHC 3956 (QB), fundamentally changes the approach to anonymity in approval hearings.

Cloisters’ barrister William Latimer-Sayer persuaded the Personal Injury Bar Association to intervene in the appeal. He was assisted by the research of Sian McKinley.  The Personal Injury Bar Association’s submissions were ultimately accepted.  The Court of Appeal’s landmark decision led to a radical overhaul in the way that applications for anonymity are dealt with at approval hearings which are required on the settlement of all claims for children and protected parties.

Cloisters is recognised for its many notable successes in high value personal injury cases. Recent examples such as James Robshaw (a child by his mother and litigation friend Suzanne Adams) v Lincolnshire Hospitals Trust in which William Latimer-Sayer, instructed by Shoosmiths LLP acted for the claimant saw the highest ever clinical negligence court award in history.

In this case the child, James Robshaw, suffered catastrophic injuries as a result of obstetric negligence. Liability was admitted and the High Court ruled that United Lincolnshire Hospitals NHS Trust must pay £14.5 million for his birth injuries after failing to carry out a Caesarean section on his mother and properly monitoring her during labour.

The Eclipse Proclaim Personal Injury Awards, now in their eighth year, bridge the partisan ‘claimant/defendant divide’ by encompassing all professionals and key service providers working in the Personal Injury field. Over 400 guests attended the event that was held at The Grange, St Pauls in London on 26 November 2015.
