Tirkey v Chandok: caste debated in the Commons and Lords

The first instance decision of Tirkey v Chandok has been debated in both Houses of Parliament: see Hansard at http://www.publications.parliament.uk/pa/cm201415/cmhansrd/cm140709/halltext/140709h0002.htm and http://www.publications.parliament.uk/pa/ld201314/ldhansrd/text/140506w0001.htm. It is clear that the Government is considering the effects of the decision which established for the first time that caste in principle could amount to an aspect of race for the purposes of the Equality Act and as such caste discrimination is actionable in the ET. The Respondents have obtained leave to appeal this decision and seek, inter alia, a reference to the CJEU. The matter shall appear before the President of the EAT towards the end of the year.
