PI & CN seminar 'litigating and settling heavy cases'
28 September 2010
Cloisters' personal injury and clinical negligence experts have given a seminar on Adding Value : Litigating and settling heavy cases.
The seminar gave practical pointers for maximising claims by grievously-injured clients, including setting up a care regime; adducing the right care evidence; proving hypothetical career paths; the importance of equipment and new technologies; and supporting Court of Protection and deputyship costs. Also covered were complications around settlement of heavy cases in relation to negotiations against multiple defendants; the Part 36 code; privilege and disclosure issues (such as the expert who caves in); ATEs and CFAs (particularly conflicts of duty in the context of offers); and tactical use of periodical payments arguments.
The seminar was delivered by Joel Donovan and Hannah Tucker and the full notes can be viewed along with the supporting presentation.
