Cloisters is at the heart of all the major equality and discrimination cases and plays an important role in the development of law and policy in this area.  Our barristers cover every aspect of discrimination and equality law.

Major test case litigation that we have acted in has set the terms of equality law, ranging from the end of a default retirement age through Heyday/Age Concern; extending discrimination law to cover carers of disabled people in Coleman v Attridge Law; obtaining the first injunction against a bank for failing to provide accessible service (Allen v RBS); to establishing the scope of the protection to be given to volunteers under discrimination law (X v Mid Sussex CAB). 

The ground-breaking work of our team has recently included one of the biggest ever multi-million pound equal pay cases (Birmingham City Council) and a complex, precedent-setting pregnancy discrimination and harassment case within the armed forces.  

We regularly advise and act on behalf of the Equality and Human Rights Commission. During the passage of the Equality Act 2010 we were involved in drafting amendments and briefings as well as advising several NGO and statutory bodies on the implications of the Act for future policy and practice.

We are currently writing the Discrimination Law Handbook for Legal Action, which will explain and provide a practical guide to the employment provisions of the new legislation, and have contributed to Equality and Discrimination – the New Law (Jordans) and the forthcoming Guide to the Equality Act 2010 (Blackstones). 

Cloisters undertakes all kinds of discrimination law in areas outside of employment such as advising on and litigating in relation to the Equality Duties and the Human Rights Act (as well as extensive advice on the UN Convention on the Rights of persons with disabilities); and discrimination in relation to goods facilities and services, as well as groundbreaking cases under the European provisions on accessible air transport.  Our pioneering cases have ranged from access to high street banks to ensuring local authorities take the needs of disabled persons into account in licensing decisions (Lunt).
