personal injury

Our personal injury barristers are some of the very best in the field.  They’ve appeared in many of the biggest and most complex cases and recovered hundreds of millions of pounds for injury victims. In 2010 we estimate that our barristers were involved in cases recovering in excess of £135 million for injury victims by way of trial or settlements. In 2011 Joel Donovan and Patricia Hitchcock were appointed silk.

We have particular expertise in catastrophic brain injury and spinal injury claims including recently Pankhurst v White, a High Court tetraplegia case involving an award of more than £6m; Houghton, a £4m claim for a severely brain damaged infant following an RTA; D V F, a 3.9 million paraplegia case, Mohamed, the then highest ever reported RTA settlement at £11.5m and B v M a £5m partial tetraplegia case.

Recent Court of Appeal cases include Connor v Surrey County Council, a personal injury stress claim; Stanton v Collinson (no contributory negligence for failure to wear a seat belt); Noble v Owens (where the defendants sought to reopen a £3m claim on the grounds of fraud), Henry v Thames Valley Police (successful claimants appeal against finding that a police officer had not been negligent when he ran over a motorcyclist who had failed to stop) and the Godstone Farm e-coli group action.

We’ve been instructed in many of the landmark PI cases in recent years including the leading House of Lords stress claim Barber v Somerset County Council; Majrowksi v Guys and St Thomas’s, the leading House of Lords case on harassment; Hartman v South Essex Mental Health and Community Care NHS Trust, one of the leading Court of Appeal level stress claims; A v Hoare, the House of Lords lotto rapist case – extending limitation for rape victims; and Gravil v Redruth Rugby Football Club (vicarious liability for pitch violence by employed players).
