Caspar Glyn KC Successfully Represents Employer in ‘No Jab, No Job’ Tribunal

The Employment Tribunal has issued its judgment regarding 5 lead cases against Barchester Care Homes in a ‘no jab, no job’ case arising out of the pandemic. A nurse, 3 care assistants and a laundry assistant challenged Barchester’s policy to dismiss employees who were not vaccinated against Covid-19 and did not have a medical exemption during the pandemic.

The Tribunal held that Barchester’s reason for dismissal was a substantial one, that the processes were fair, the dismissals were fair and non-discriminatory. In so far as any religious or philosophical belief had been engaged, then the decision not to pay a discretionary bonus to those who refused the vaccine and or to dismiss them was justifiable.
