Today, the Times has named Jonathan Mitchell QC of Cloisters and Arnot Manderson Advocates Scottish Lawyer of the week.
Jonathan acted for Cumbria, Stockport and Blackpool councils in the landmark Court of Session case of Cumbria CC and Others, 2017 SLT 34, where the court used its extraordinary equitable jurisdiction to enforce orders by the English courts to place four children in secure accommodation in Scotland; an unprecedented use of its powers. Jonathan specialises in public and human rights law and particularly in cross-border issues, which are becoming increasingly common in practice.
In an interview Jonathan Mitchell said: “The core problem was intellectual: to think of a solution to a cross-border problem previously thought insoluble. It had to be one which protected not only my clients, but the children and care workers, and which didn’t prejudice the need for proper legislative change.
