Are judges workers? Chris Milsom intervenes in Gilham v Ministry of Justice

Chris Milsomwill appear as junior counsel for the intervener, Protect, in the Supreme Court appeal of Gilham v Ministry of Justice on 5-6 June 2019.

The Supreme Court will consider whether judges are to be regarded as workers entitled to pursue whistleblowing complaints before the ET. Protect will argue that the need for a contract of employment as a basis of conferring whistleblowing protection where an individual is nonetheless in an employment relationship amounts to an unjustified infringement of Articles 10 and 14 ECHR. In addition to the obvious impact of the appeal on judges the intervention has significant implications for many office-holders which range from company directors to the clergy.
