The Employment Tribunal rules that ‘Limb (b) workers’ are entitled to protection under TUPE.
In a decision handed down yesterday (Tuesday 26th November) Employment Judge Joffe has held that the Transfer of Undertakings (Protection of Employment) Regulations 2006 applies to ‘workers’ as well as traditional ’employees’.

As a result, workers’ contractual and statutory rights should continue seamlessly after a business transfer or service provision change. Further, employers will be required to inform and consult with workers about a relevant transfer in the same way as they do with employees.
