Sheryn Omeri interview: legitimate expectation of independence in gov inquiry

Cloisters’ Head of Public Law, Sheryn Omeri, was interviewed by LexisNexis Current Awareness about the case of R (on the application of Bernadette Sargeant) v First Minister of Wales & Anor in which she acted for the successful Claimant, widow of the late Carl Sargeant AM, together with Leslie Thomas QC.

The Divisional Court held that a public statement by a politician was sufficient to create a legitimate expectation that he would act in accordance with that statement. The case makes an invaluable contribution to the public law doctrine of legitimate expectation.
